1. Acceptance of Terms

By accessing or using the Otoq platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Otoq provides an AI-powered customer engagement platform that allows you to create AI agents trained on your business data. These agents can be embedded on your website via a chat widget to handle customer support, lead qualification, and sales conversations. Otoq is operated from Manila, Philippines.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old to create an account.

4. Subscriptions and Billing

Otoq offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

  • You may cancel your subscription at any time through your account settings or the Stripe customer portal.
  • Cancellations take effect at the end of the current billing period.
  • We reserve the right to change our pricing with 30 days' notice.

Pricing: Our current plans are Starter ($49/mo), Growth ($149/mo), and Pro ($299/mo). Annual plans are available at a 20% discount. All prices are in USD. The Free plan includes 50 conversations per month at no cost.

5. Refund Policy

We want you to be satisfied with Otoq. Here is our refund policy:

  • 7-day satisfaction guarantee: If you are not satisfied with your paid plan within the first 7 days of your initial subscription, contact us at support@getotoq.com for a full refund.
  • After 7 days: We do not provide refunds for partial billing periods. You may cancel anytime and your plan remains active until the end of the current billing cycle.
  • Annual plans: Annual subscriptions may be refunded on a pro-rata basis within the first 30 days if you contact support.
  • How to request a refund: Email support@getotoq.com with your account email and reason for the refund. We process refunds within 5-10 business days.

6. Usage Limits

Each plan includes specific usage limits (conversations per month, number of agents, knowledge sources). If you exceed your plan limits, your AI agents may stop responding until the next billing cycle or until you upgrade your plan. We reserve the right to enforce fair usage policies.

7. Your Content

You retain ownership of all content you upload to Otoq, including knowledge base documents, business data, and agent configurations. By uploading content, you grant us a limited license to process, store, and use this content solely to provide the Service to you.

You represent that you have the right to use and upload all content you provide, and that such content does not violate any third-party rights or applicable laws.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Train AI agents with harmful, misleading, or deceptive content
  • Attempt to bypass usage limits or rate limiting mechanisms
  • Use the Service to send spam or unsolicited messages
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity, or misrepresent your affiliation

9. AI-Generated Content

AI agent responses are generated by artificial intelligence based on your knowledge base data. While we strive for accuracy, AI responses may occasionally be incorrect, incomplete, or inappropriate. You are responsible for reviewing and monitoring your agent's responses. We are not liable for any actions taken based on AI-generated responses.

10. Limitation of Liability

To the maximum extent permitted by law, Otoq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Account Termination

We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service will immediately cease, and all associated data will be permanently deleted.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms will be resolved through the appropriate courts in Manila, Philippines.
